POSITION SUMMARY
Prosecutes and manages a personal case load of one or more areas of focus, which may include BMI infringements, arbitrations, estate, creative disputes, and creative drafting files. Participates in matters undertaken by the Legal Department including negotiations, drafting, and a wide range of litigation.

FUNCTIONS OF THE JOB
Essential Functions: which may be representative but not all inclusive of those commonly associated with this position.

  • Prosecutes and manages a large caseload of copyright infringement actions throughout the U.S., including drafting motion and discovery papers, negotiating settlements, reviewing song ownership documentation, attending settlement conferences and supervising outside counsel.
  • Prosecutes and manages numerous collection arbitrations involving BMI licensed businesses, venues, radio and TV stations, including supervising collection attorneys throughout the U.S. and negotiating settlements.
  • Manages estate files to affect an orderly transition from the deceased affiliate to their successor. Engages in communications with estates of decedent writers, obtain new membership agreements with the estate; obtains all necessary testamentary documentation.
  • Analyzes any legal issues affecting BMI royalty distributions in disputes between songwriters, composers, music publishers and other third parties with respect to authorship, copyright ownership and/or royalty share entitlement. Communicates BMI’s official position to interested parties and manages the implementation of any resolution.
  • Drafts and reviews agreements between BMI and its affiliated songwriters, composers, music publishers and other stakeholders; provides advice on, and/or drafts, a variety of legal contracts between BMI and outside vendors.
  • Applies legal expertise with the intention of closing deals before the need for litigation.
  • Provides legal and business-related advice to the Company.
  • Interacts with other BMI departments and advises on legal options.
  • Participates in company strategic initiatives.
  • Provides advice and counsel on copyright, contract, and other legal issues.
  • Researches and drafts business and legal memoranda on matters of importance to BMI.
  • Interacts with other BMI attorneys and BMI management with respect to own areas of responsibility.
  • Manages and works effectively with outside counsel.
  • Maintains knowledge of the latest developments in copyright and IP matters, and applicable laws and regulations.
  • Assists other BMI attorneys and interacts with BMI management with respect to the above responsibilities.
  • Regular attendance.
  • Other duties as assigned.

POSITION QUALIFICATION REQUIREMENTS

Education: 4-year college degree and Juris Doctor degree from an accredited law school required. Admitted to the Tennessee State Bar or New York State Bar with qualification to register as in-house counsel in Tennessee. In addition, fulfilling continuing legal education requirements is also required.

Experience: Minimum three (3) years legal experience, at least a portion of which should be in private practice in a law firm or in-house experience in the music industry. Background in litigation, including researching and drafting of briefs and memoranda and motion practice is a plus. Prior knowledge of U.S. copyright law and/or music industry experience is a plus.

  • Strong proficiency in Microsoft Office suite – including Word, PowerPoint, Excel, Teams, SharePoint, etc.
  • Ability to analyze business problems from a legal and practical perspective.
  • Some travel required

LICENSE(S)/CERTIFICATIONS REQUIRED
Admission to the Tennessee State Bar or New York State Bar with qualification to register as in-house counsel in Tennessee. Eligibility to practice in the federal courts is required. Notary Public license is desired, but not necessary.

SALARY RANGE

The specific base salary offered to a successful applicant will be based on individual qualifications, skills, experience, and education. The pay range is subject to change at any time based on various internal and external factors. The position may also be eligible for one or more performance-based bonuses.
